Member acknowledges that messages, files or other materials ("Content") contained on the Funzy website and within Funzy email messages, and third party advertisements on the website and distributed via email, of a commercial nature and presented to Member by Funzy and the Services, are protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws. Member is permitted to use Funzy Content or third party Content only as expressly authorized by Funzy or the third party advertiser. Member may not copy, reproduce, distribute, or create derivative works from the Funzy Content or third party Content without expressly being authorized to do so by Funzy or the third party advertiser. Member may make a copy of the Funzy Content or third party Content for Member's personal, noncommercial use only, provided that Member keeps all copyright or other proprietary notices intact. Although Funzy does not claim ownership of content that its Member's may provide to Funzy, by providing content to Funzy, Members automatically grant, and represent and warrant that they have the right to grant, to Funzy a worldwide, irrevocable, perpetual, non-exclusive, and fully sublicenseable, license to use, copy, perform, display, and distribute said content.

Funzy respects copyright law and expects Members to do the same. Illegal or unauthorized copying, distribution, modification, public display, or public performance of copyrighted works is an infringement of the copyright holders' rights. If you believe that your work has been copied in a way that constitutes copyright infringement, or your intellectual property rights have been otherwise violated, please notify Funzy's Agent for Notice of claims of copyright or other intellectual property infringement ("Agent"), at:

To be effective, the Notification includes the following:

1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
2. Identification of the copyrighted work claimed to have been infringed, or if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site;
3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the service provider to locate the material;
4. Information reasonably sufficient to permit the service provider to contact the complaining party, such as an address, telephone number, and if available, an electronic mail address at which the complaining party may be contacted;
5. A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
6. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Please report to Funzy if materials and works are found to be infringing and a written Notification should be sent to copyright@funzy.com. Funzy will remove or disable access to the materials or works that are alleged to be infringing in 48 hours and Funzy has rights to forward the written Notification to such alleged infringer. Funzy will promptly notify subscribers that the material has been removed or disabled.
